Terms and Conditions

Welcome to Viper Desktop and Viper iPhone software, Viper Algo, VIPER discord, and TradingView Algo (all five collectively the “Tech”). By accessing or using this Tech, you agree to be bound by these Terms and Conditions (the “Agreement”). If you do not agree to these terms, please do not use the Tech.

1. No Investing or Trading Advice

The content provided on this Tech, including securities sentiment (Bullish or Bearish), analysis, and opinions, is for informational purposes only and does not constitute financial, investing, trading, or other professional advice. You should not rely on this information as the basis for making any investing or trading decisions. Always consult with a qualified financial advisor before making any investing or trading decisions.

2. No Guarantees

There are no guarantees or assurances that the information provided on this Tech will result in profitable investments or trades. Past performance is not indicative of future results. All investing and trading involve risk, including the loss of principal.

3. Limitation of Liability

To the maximum extent permitted by law, JunoTrade Corporation, its affiliates, employees, officers, directors, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Tech.
• Any reliance on information provided on the Tech.
• Any errors, mistakes, or inaccuracies in the content provided.
• Any unauthorized access to or use of our servers and/or any personal information stored therein.
• Any interruption or cessation of transmission to or from the Tech.

4. Indemnification

You agree to indemnify, defend, and hold harmless JunoTrade Corporation, its affiliates, employees, officers, directors, agents, and licensors from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the Tech.
• Your violation of this Agreement.
• Your violation of any third-party rights, including but not limited to intellectual property rights or privacy rights.

5. Disclaimers

• The Tech is provided on an “AS IS” and “AS AVAILABLE” basis. JunoTrade Corporation makes no representations or warranties of any kind, express or implied, regarding the Tech or its content, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• JunoTrade Corporation does not warrant that the Tech will be uninterrupted, error-free, secure, or free from viruses or other harmful components.

6. Third-Party Links

The Tech may contain links to third-party websites or services that are not owned or controlled by JunoTrade Corporation. JunoTrade Corporation has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that JunoTrade Corporation shall not be liable for any damages or losses caused by your use of or reliance on any third-party content, goods, or services.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Texas, USA, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be exclusively brought in the courts located in Texas, USA, and you consent to the jurisdiction of such courts.

8. Severability

If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement shall remain in full force and effect.

9. Changes to this Agreement

JunoTrade Corporation reserves the right to modify or replace this Agreement at any time. If a revision is material, we will provide at least [30 days’] notice prior to any new terms taking effect. By continuing to access or use the Tech after those revisions become effective, you agree to be bound by the revised terms.

10. Termination

JunoTrade Corporation may terminate or suspend your access to the Tech immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach this Agreement. Upon termination, your right to use the Tech will immediately cease.  If your access to Tech is terminated for any reason, including your own cancellation, you agree to delete the TradingView Algo viewer layout you were provided.  Continued unauthorized use will result in liability for monthly fee for every month you continue to use it.  If we detect unauthorized usage, you will be billed.
